CaptionsXR Terms of Service

1. Acceptance of Terms

By accessing and using the services of CaptionsXR ("Service"), you are agreeing to be bound by the following terms and conditions ("Terms of Service"). If you do not agree to these terms, do not use the Service.

2. Description of Service

CaptionsXR provides a platform that allows users to upload videos, generate captions, and edit the videos to include those captions. Users can then upload these edited videos to their connected YouTube or TikTok accounts.

3. User Accounts

To use our Service, you must create an account using your Google and/or TikTok credentials. You are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer. You agree to accept responsibility for all activities that occur under your account.

4. Content and Conduct

You retain all ownership rights to the content you upload. By uploading content to the Service, you grant CaptionsXR a worldwide, non-exclusive, royalty-free license to use, host, and process the content solely to provide the Service.

4.1. Prohibited Content

You agree not to upload content that:

  • Violates any law or regulation.
  • Infringes on the intellectual property rights of others.
  • Contains harmful, offensive, or inappropriate material.

5. Privacy Policy

Our Privacy Policy, which describes how we handle your personal information, is available here. By using the Service, you agree to the collection and use of information in accordance with our Privacy Policy.

6. Termination

CaptionsXR reserves the right to terminate or suspend your account and access to the Service at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason.

7. Limitation of Liability

To the maximum extent permitted by law, CaptionsXR shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

  • Your use or inability to use the Service.
  • Any unauthorized access to or use of our servers and/or any personal information stored therein.
  • Any interruption or cessation of transmission to or from the Service.
  • Any bugs, viruses, trojan horses, or the like that may be transmitted to or through our Service by any third party.
  • Any errors or omissions in any content or for any loss or damage incurred as a result of your use of any content posted, emailed, transmitted, or otherwise made available through the Service.

8. Governing Law

These Terms shall be governed and construed in accordance with the laws of the jurisdiction of Victoria, Australia, without regard to its conflict of law provisions.

9. Changes to Terms

CaptionsXR reserves the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 14 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
